Agreement eliminates Puett fence

A district court hearing on a request by the Colorado Division of Wildlife to make developer Jim Kreutzer remove a barbed-wire fence that blocks access to A.M. Puett Reservoir was canceled Friday after both sides settled on a temporary agreement that they submitted to District Judge Sharon Hansen, a district court clerk said.

Puett Reservoir is a local fishing hole and recreation area near Summit Ridge. In December, Kreutzer’s company, Echo Basin, LLC, fenced off the road leading to the boat ramp to discourage trespassers on its property.

The DOW asked on Monday for a preliminary injunction to force Kreutzer to remove the fence while its request for a permanent injunction works its way through the judicial system.

Floyd Smith, an attorney representing Echo Basin, said Friday that under a proposed "stipulated injunction," which will remain in effect until the other case is resolved, Kreutzer agrees to remove the fence at the boat ramp, but will be allowed to place large rocks around an adjacent campground to prevent vehicles from driving onto Kreutzer’s property.

Hansen hadn’t ruled on the agreement by press time, according to a clerk.
